1. Limitation of Liability
To the maximum extent permitted by law, BoatSnaps and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Platform.
2. Liability Cap
In no event shall BoatSnaps' total liability exceed the amount you paid to BoatSnaps in the twelve (12) months preceding the claim. Some jurisdictions do not allow liability limitations; this section applies to the extent permitted by law.
3. Matters Outside Our Control
BoatSnaps is not responsible for weather, mechanical failures, operator cancellations, accidents, injuries, Coast Guard actions, permit violations, or disputes between users. These matters are the responsibility of the relevant Service Provider.
4. Marketplace Provider Limitation
As a marketplace and technology platform, BoatSnaps facilitates connections but does not provide the charter services. BoatSnaps is not liable for the acts or omissions of independent Service Providers.
5. Governing Law
This policy is governed by Florida law. Venue shall be Miami-Dade County, Florida. Disputes are subject to the arbitration and class-action waiver in our Terms of Service.
